WASHINGTON – The Obama administration filed court papers Monday claiming a federal marriage law discriminates against gays, even as government lawyers continued to defend it.
Justice Department lawyers are seeking to dismiss a suit brought by a gay California couple challenging the 1996 Defense of Marriage Act. The administration's response to the case has angered gay activists who see it as backtracking on campaign promises made by Barack Obama last year.
In court papers, the administration said it supports repeal of the law.

Cheers and a big wave of the flag we haven't designed for ourselves yet.
The insidious "Defense of Marriage Act" is brilliantly titled—one more example of right-wing political command of language. Meant, of course, to instill the anxiety among all those redblooded American married couples that any kind of marriage not involving a man and a woman will ... in some never-quite-specified fashion ... eat away at the *very foundations of their marriages!*
Gosh ... my wife and I have been married over forty years, and gee whiz, we've searched and searched and can't find even one teeny little aspect that's harmed by gay marriage—let alone needed defense from that pustulent Act.
On the contrary, the knowledge that our close friends who are gay, now married quite a few years themselves and a loving and happy couple, are every bit as married as we are, makes us feel proud of the institution of marriage.
Maybe all those divorcing and tomcatting right-wingers whose scandals are regularly in the news should put their own house in order first?
I feel the only thing my marriage needs defense from is ... the Defense of Marriage Act. Jeepers.
Robyn:
Your point of "put their own house in order" is more revelant today that it has been in years. Too bad the leaders lack the moral fiber necessary to be role model leaders.
